Do Not ‘Do It Yourself’

Florida’s Uniform Premarital Agreement Act (UPAA) sets out certain specific criteria that a prenup must have in order to be considered enforceable, and establishes a few things that may not be handled in a prenup. While this still gives couples considerable room to maneuver in creating their prenuptial agreement, it is far too easy for the average person to either ignore or omit details that can be problematic down the line.

For example, two people may decide that in the event of a divorce, one partner should get all of the marital assets because the other has a high-paying job. Since both consent, a couple may have no qualms about this arrangement. However, Florida has a rule that if a divorce settlement is one-sided enough where the other partner may be eligible for public assistance (what if that partner loses their job?), the court will either demand they receive spousal support or declare that part of the prenup unenforceable due to inequity.
